Judge Denies Julie Chrisley’s Request to Appear at Resentencing Hearing Remotely After Julie Claimed Attending In-Person Would Cause Her “Undue Physical Hardship” From Being Shackled For Hours-Long Car Trip

UPDATE! The Ashley can confirm that, on Wednesday, a judge denied Julie’s request to appear at her resentencing hearing remotely. In a Writ of Habeas Corpus ad Prosequendum issued on August 7, Judge Eleanor L. Ross demanded that the reality star appear in-person in the Atlanta courtroom that the hearing is taking place in on September 25…and she wants Julie cuffed up.

Judge Ross issued the notice to law enforcement, writing that, “You are hereby commanded to have the body of Julie Chrisley by you restrained of her liberty.” Judge Ross ordered that Julie be brought to the courtroom each day until she is discharged by the Court. 
She is then to “be sentenced and receive and abide by the judgement of this Court in the above-entitled case, thence to be returned to the custody from which she came.”

Julie Chrisley is set to be resentenced in District Court next month, though the former Chrisley Knows Best star is asking that she not be required to attend the hearing in-person, as it will allegedly cause her “undue physical hardship.” 

In Julie’s recently filed motion, she explains that the Bureau of Prisons “likely would transfer her via the transfer facility in Oklahoma City or place her in a van for a lengthy, multiple-hour trip while shackled to facilitate her appearance in court.”

As The Ashley previously told you, Julie and her husband Todd Chrisley are currently serving prison time for tax evasion and fraud crimes– six years for Julie and 10 years for Todd, following the couple’s sentences being reduced in September. 

 

The pair are in the process of appealing their criminal convictions and last month, Julie’s prison sentence was overturned by the appeals court after it was determined that there was not enough evidence to tie Julie to crimes that had occurred prior to 2007. As a result, a judge ordered that Julie be resentenced in District Court. 

In court documents obtained by In Touch Weekly, Julie has requested that she be allowed to attend her September resentencing hearing remotely via video conference instead of in-person, claiming that transporting her from the Lexington, Kentucky, prison where she is serving her time to Georgia–- where the hearing is scheduled to take place–- will require accommodations that are less-than-desirable.  

“Will the prison vans be seated according to class?! I hope they’re not too crowded.”

The motion goes on to claim that “either option would remove Ms. Chrisley from FMC Lexington for an unnecessary extended period of time and impose undue physical hardship on her.” 

While Julie’s lawyer said prosecutors have not opposed Julie’s request to attend the hearing remotely, the judge presiding over the case has yet to sign off on her request. 

Julie is scheduled to be resentenced September 25.

  1. Julie I still love you and your precious family. You and yours brought me much entertainment and. laughs regardless of what was going on in the background!!! I miss every one of you and spend some days searching the internet looking for what the kids are doing!!! We all make mistakes and God does love us all !!!!


  2. It makes me so sick that they would do this to Julie. What does it accomplish to put her in a bus chained up & go for this long ride to go to court & then have some judge be so mean to her. With this causing medical problems that make it very hard for her then why can’t this judge be considerate of that & ok the remote viewing? God 🙏 be with you Julie. 💕🌈


    1. She is a FEDERAL PRISONER !!!! The DOC are NOT obligated to make sure she has a pleasant, first class trip to Ga. Just because Julie was on TV cooking up meals and playing innocent housewife to Todd, doesn’t give her special privileges. They defrauded millions. Smdh


    2. Because that’s how they transport prisoners. She’s not helping herself by acting like an entitled brat. Just shut up and play along! People deal with much tougher treatment. If she didn’t break the law….well you know the rest.


  3. I really don’t mean to come off mean but Julie do you think you are better than others or special? Did you think when you were committing those crimes that nothing would happen to you that you were better than others because you had a reality show guess what this is your reality. You should be happy you are getting a resentencing and be happy to go to that Courthouse not whining. Woman to your crimes and get better good luck to you and God be with you


  4. Maybe if she showed a little remorse and they took some responsibility for their actions they would have gotten some relief. But acting entitled isn’t going to help them at all. Someone needs to tell Savannah that she isn’t helping matters either. I get that she loves them and wants the best for them but they are where they are because they broke the law. They don’t deserve designer accomodations. It’s Jail!! Show some dignity and grace.


    1. Right! Julie would get an air conditioned car and court house, not to mention probably better food and no rodents. “Undue physical hardship”? How!? Julie acts like she’s so busy…


  5. This is the same case where they agreed she definitely did it, but maybe not at long as they thought, right!?!?!

    I’m not saying that criminal justice in the US need overhauling, but Julie did the crimes she is convicted of, her husband did them too. They still benefit from the criminals they were convicted of, their children benefit from those crimes.

    So they can say that they don’t deserve all of this, but when they leave prison on the last day of their sentence, they will put on their Designer clothing and they will be picked up in a luxury car by their daughter, to be driven back to their multi-million dollar house, where they have millions of dollars worth of furnishings and clothing and electronics. Where they will be able to continue making money off talking about their time in prison for the crimes they did do, and cry about how hard it was.

    I remember a woman got like 7 years in jail because she used her father’s address in the town over to get her kids into a better public school. Her father lived in that school district and was a retired senior, she shouldn’t have lied. She should have just moved in with him for a few years to allow her kids to access legally to go to that public school. 100%. I get it, but she was literally trying to give her kids a better life and she got 7 years in jail, and had to pay back the state, like half million in the cost of her kids education, which is still paying off.

    Julie and Todd lied and defrauded banks so they could buy more Chanel and Dior and Mercedes and whatever other stupid luxury products. And people say, oh its a victimless crime, BS. You think the banks take on those losses, no they push that on all the other bank account holders.


  6. Boo hoo. But in all fairness, conducting the trial via video would save taxpayer money. Taxes she didn’t contribute to.
