Bar Smith’s Motion to Get His Bail Reduced Backfires; Prosecutor Asks To Increase ‘Teen Mom’ Star’s Bail Due to Past Criminal Antics

“It’s times like this when I’m glad I have four eyebrows to truly capture my emotions.”

Bar Smith’s recent attempt to get out of jail and/or have his $35,000 bail lowered has blown up in his face.

The Teen Mom dad— who has been in jail since July— was planning, along with his public defender, to try to convince the court to release him from the slammer on his own recognizance or reduce his bail, which is currently set at $35,000. Although Bar and his public defender have been arguing that Bar is not a flight risk or a danger to society, the prosecutor– once hearing about Bar’s criminal past and antics in California and Nevada— not only disagreed but was fighting to actually increase Bar’s bail— to $150,000!

Starcasm reports that the prosecutors filed an opposition to Bar’s motion to release him/reduce bail, one day before Bar’s case was due to be heard in court.As The Ashley previously reported, the estranged husband of Ashley Jones was arrested July 7 following an altercation between him and Ashley. As a result, Bar has been in jail in Nevada since then on felony charges of kidnapping, coercion and burglary.

The Ashley broke the news that Bar’s public defender filed a motion August 8 requesting that Bar be released on his own recognizance, or that the $35,000 bail amount be reduced. According to Starcasm, Bar’s attorney stated that Bar “is unable to afford the current bail,” and because of that, “the current bail setting is acting as a detention order.” (Basically, the public defender is saying that it’s like Bar has already been giving a jail sentence, since he can’t afford the bail and has to stay in jail.)

In the motion, Bar’s attorney insisted that Bar was neither a flight risk, nor “a danger to the community,” but rather only a danger to Ashley.

While Bar’s motion was scheduled to be heard August 22, Starcasm reports that prosecutors filed an opposition to the motion the day prior asking that Bar’s bail be increased to $150,000 with High Electronic Monitoring and a No Contact Order with Ashley. Prosecutors cited Bar’s criminal history as the reason behind the proposed bail increase, as well as the July incident involving Ashley, in which Bar traveled from California to Nevada to allegedly confront Ashley over her social media activity.

“Defendant’s criminal history, violent nature and willingness to fly from California to Nevada from one social media post, is incredible alarming and proof that he is likely to jeopardize the safety of the community, Ashley, and her family,” the prosecutor’s motion stated.

“Defendant states how this is a case where there was no alleged physical altercation or injuries of any kind, and therefore is not a danger … New information was testified to during the preliminary hearing that Ashley was in fear for her life, which is why she had her mother on standby to call the police … .”

The prosecutor also claimed in the motion that, because Ashley– who shares daughter Holly with Bar– “knew help was on the way,” she was able to act in a calm manner and make sure “not to agitate [Bar] more in an attempt to avoid any physical escalation.” 

The prosecutor also took statements from Ashley’s parents, both of whom stated that Bar has gotten physical in the past with Ashley, their family and others. 

“In their voluntary statements, Ashley’s parents indicate the violent behavior that Defendant has exhibited towards the entire family for quite some time now,” the prosecutors stated.

Tea claimed Bar “shot up my daughter’s home as we were celebrating her medical [assistant graduation] party,” which resulted in Bar being arrested. (This incident was addressed on an episode of Teen Mom 2.) 

Ashley’s mom talked about having to go get Ashley from her house because Bar allegedly “had a gun holding her hostage.” She also claimed that Bar has harassed her family in various places.

“The last seven years has been a nightmare,” Tea wrote, according to Starcasm. “I’m a retired pastor and Bariki has shown up to my church services to fight my children. He has jumped my deceased son, fought my oldest daughter & my husband… He keeps the family in fear with threats and violence that WE KNOW HE WILL DO! We have watched him with our own eyes pull guns on people.”

“At this point we are looking over our shoulder scared because we don’t know when he will just show up and start beating on my daughter again,” Tea added.

Ashley’s dad Ted Chapple also had a lot to say about Bar and his past antics.

“The destruction to property he has done — the family as a whole is totally done with him. The only reason our daughter deals with him [is] because they have a six-year-old daughter together,” Ted wrote, adding that Bar has “used guns in the past to get his way.” 

“So, we have been dealing with his antics for a long time and are tired of it,” he added. “He has put enough people in harm’s way for his own betterment. Simply put, we don’t and won’t deal with him and his foolishness.”

Due to the prosecution’s strong arguments against Bar— and the prosecutor’s attempt to actually increase Bar’s bail— Bar and his attorney have withdrawn their motion to have Bar released and/or have the bail reduced. 

At this time, Bar remains in custody at the Clark County Jail. A status check hearing has been set for September 24; Bar’s trial is scheduled for October 21.

  1. I bet Bar is wishing he was back in California. Unlike CA, the State of Nevada takes violent crime much more seriously and they hand out real, prison sentences. Nevada isn’t CA or, just as lenient, Cook County (Chicago). Bar deserves whatever he has coming.
