EXCLUSIVE! ‘Sister Wives’ Star Kody Brown Lawyers Up; Files Response to Ex Christine’s Custody/Child Support Lawsuit Against Him

“It’s like a KNIFE in my pocketbook to have to hire a lawyer!”

The battle between Kody Brown and his (third) ex-wife, Christine continues!

The Sister Wives star– who was sued last month by Christine for child support and custody of their youngest child, Truely— has hired himself a lawyer and filed a response to Christine’s lawsuit. According to online court documents viewed by The Ashley, Kody’s newly hired lawyer appeared for him on October 13. 

On Wednesday, Kody and his attorney— who is based in Utah, where Christine lives and filed her lawsuit– filed a response and counterclaim to what Christine stated in her lawsuit.

As The Ashley reported, Christine, using her married name “Christine Woolley,” filed a “Petition for Declaration of Paternity, Child Custody, Parent Time, and Support” on September 16 against Kody.

In the petition, Christine demanded that Kody take a paternity test to show that Truly is his biological daughter. (As ‘Sister Wives’ fans will remember, Christine was Kody’s third wife. Since their marriage wasn’t legal and they weren’t open about being polygamists, Kody’s name didn’t appear on any of the birth certificates for his and Christine’s six kids.) 

“I mean, lookit! I was there for Truly’s birth…well, most of it…”

It appears that the paternity test may be underway as well, as a fee was paid for something paternity-related on Wednesday, the same day that Kody filed his answer to Christine’s lawsuit. 

Christine (and/or Kody) have taken steps to keep the public from knowing personal, family information (which could include income declarations and other private info). The information contained in Kody’s response/counterclaim has been marked “not public” and is not able to be viewed by anyone other than the courts, Kody and Christine and their legal counsel. 

(Speaking of their legal counsel, Kody’s lawyer currently only has one out of five stars on Yelp, as well as on avvo.com, a website that helps people find lawyers and get legal information.)

“That’s me, so I have to take any lawyer I can get, guys!” 

Although the actual petition has been sealed from public view, The Ashley confirmed last month that a “Domestic Relations Injunction” was also filed alongside Christine’s paternity suit.

This injunction states that neither party can “harass, intimidate or disturb the peace of the other party, by any means, including electronically.” It also forbids both parties from committing “domestic violence or abuse against the other party or a child.”

The injunction also sets rules for both parties when it comes to dealing with Truly while the court case is active. Neither parent can take Truly on a trip unless the other party consents and has the travel details and a way of contacting Truly. They are also forbidden from saying anything to “demean or disparage (talk badly about) [about] the other party” in front of or within earshot of Truly, nor can they “attempt to influence the children’s preference regarding custody or parent time.”

The injunction forbids Kody and Christine from saying or doing “anything that would negatively affect the love and affection of the children for the other party, or involve the children in the issues of the petition.”

Both have to ensure that no one else who is around Truly can do anything that breaks these rules.

Shortly after Christine filed the lawsuit against Kody, she and her (former) sister wife Janelle did a series of interviews about their splits from Kody. During a radio interview, Christine was asked to describe Kody in three words, and her response hinted that Kody has not been financially supporting Truly and/or spending time with her recently. 

“Deadbeat dad– sorry, that’s two [words], but that can be two,” she stated. “And oblivious.” 

Christine then stated that she’s “too mad at him right now” to give a kinder answer. 

“And doesn’t ANYONE care what Robyn thinks!?”

  1. Bummer that the court filings are private. Id love to see what Kody disagrees with. Christine has the facts and evidence to prove what a shitty parent Kody is.


  2. Do you mean October 23, rather than October 13? October 13 is a Sunday and you keep referring to filings made Wednesday. October 23 was a Wednesday.


    1. @Jenn– Oddly, the date listed on the court docs is October 13 for the lawyer appearance. Not sure why it was posted on a Sunday, but it may be the day it was recorded. Or it’s possible that the court record could have it wrong. But that is the date given on the court docs. And October 23 is the date listed as the day Kody filed his response. -The Ashley


  3. I personally think Christine is just as guilty as Kody . Christine shouldn’t get back child support. It should go to the State polygamy is really fraud. Christine acts like she didn’t do anything wrong when she fraud the system by not putting his name on her kids birth certificates in the first place.

    1. Respectfully disagree. I think religious polygamy is awful and definitely doesn’t benefit women however it is a religious belief. Everyone has the right to freely choose their own religion without the state interfering. It isn’t her fault that the state outlawed polygamy and she couldn’t put his name on the birth certificate out of fear.


    2. Truly was born on the show, so I doubt Christine received any public assistance for her. Even if Kody wasn’t on the birth certificate, the state who the father was. There’s no way that wouldn’t have been flagged when they’re on TV. Besides, the state can collect child support from a dead beat to recoup their funds (as they should).

      Christine is entitled to child support for Truly and the back child support is probably only for the past couple of years after they split. Kody tried to scare Christine about making this legal, so I’m glad she’s making it official.


    3. These women were raised in this religion and followed those before her. It’s pretty easy for us to point fingers at a situation we know nothing other than tv. All of these women are now realizing what real life is about and not a cult like following.


    4. She’s entitled to child support. There’s no doubt about that. But if she did fraudulently collect welfare (I have no idea), then I agree that the State should be reimbursed.


    5. Well, you do have a point. Christine had no issue with not putting Kody’s name on the kids’ birth certificates to defraud our government (our tax dollars) to obtain financial benefits, but now she calls him a deadbeat. I am disgusted with Grody, but Christine is not innocent. I’m glad that she has changed and grown, but she was part of this cult and behavior for the majority of her adult life.


    6. They have lived in 3 states since Truly’s birth. With income from the show I doubt she was on any assistance after she was a year old and at that point living in Nevada. And child support isn’t for Christine it’s for Truly!


  4. The fact that this so called man can’t even financially support ALL of his children makes me more disgusted by him. I’m watching old sister wives episodes when Robyn and Kody were discussing getting pregnant. After 10 whole whopping months of being together Kody said to Robyn that “he wants more children”. Why?! He doesn’t actively raise or support any child that isn’t Robyn’s. He acts like his adult kids aren’t his children because they are over 18. Your kids never stop being your children and they never stop needing their parents.


    1. It was insane when Janelle was worried sick about finances (since she’s always been the main breadwinner) and she was making all kinds of cutbacks to her own home/family, but Kody and Robyn were just adding more kids to the mix!
